Master Terms and Conditions
By ticking the box and completing your purchase, you (you, your, Client) agree to be legally bound by these Terms and Conditions with Kim Jones (we, us, our).
- Master Agreement & Scope
1.1 These Terms and Conditions apply to all products, digital materials, online courses, workshops, 1:1 coaching sessions, subscriptions, and programs offered by us (collectively, the Services).
1.2 The specific details, duration, inclusions, and fee structure of the particular Service you are purchasing (the Offering) are detailed at the checkout page or point of purchase.
- Payment & Instalment Plans
2.1 You agree to pay the total cost of the Offering (the Fee) as displayed at checkout.
2.2 If you select a payment plan or instalment option:
- You authorize us to automatically charge your payment method on the scheduled due dates.
- You acknowledge that a payment plan is not a subscription that can be canceled at will. It is an agreement to pay the full cost of the Offering broken down into periodic payments. You remain legally obligated to pay all remaining instalments for the duration of the agreed period, regardless of whether you complete or access the Services.
- 1:1 Sessions, Rescheduling & No-Show Policy
3.1 More than 24 Hours' Notice: If your Offering includes individual 1:1 sessions, you may reschedule your appointment time provided you give us at least 24 hours' advance notice prior to the scheduled start time. You can reschedule by using the rescheduling link in your booking confirmation email or by emailing us directly at [email protected].
3.2 Less than 24 Hours' Notice / No-Shows: If you cancel or attempt to reschedule a 1:1 session with less than 24 hours' notice, or if you fail to attend a scheduled session (no-show), the session will be forfeited in full. No refunds, credits, or make-up sessions will be provided outside of the 24-hour window.
3.3 Punctuality: Sessions begin promptly at the scheduled time. If you arrive late, your session will still end at the originally scheduled time.
- Strict No Cancellation & Refund Policy
4.1 No Cancellations for Change of Mind: Once a purchase is completed, purchases cannot be canceled, refunded, or transferred, and you are obligated to pay the full Fee.
4.2 Immediate Access: Because access to our digital content, IP, community spaces, or reserved live sessions is granted immediately upon or shortly after purchase, you acknowledge and agree that you forfeit any right to cancel or request a refund due to a change of mind, unexpected personal circumstance, or lack of participation.
4.3 Australian Consumer Law (ACL) Notice: Nothing in these terms excludes, restricts, or modifies any non-excludable consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). If a service fails to meet an ACL statutory guarantee, you may be entitled to a remedy under the law.
- Community Standards & Provision of Services
5.1 We will provide the Services with reasonable skill, care, and diligence.
5.2 Schedule changes or technical delays may occur from time to time. Where a group live session or service is postponed by us, we will provide fair notice where possible and offer a rescheduled date.
5.3 If your Offering includes access to a private community or group platform, you agree to interact with respect, kindness, and in alignment with any posted participation guidelines. We reserve the right to immediately terminate your access to community spaces without a refund if you breach these conduct standards.
- Intellectual Property & Confidentiality
6.1 All materials, content, videos, audios, workbooks, frameworks, meditations, and techniques provided to you (the Content) are protected by copyright and intellectual property laws. All rights remain owned by Kim Jones.
6.2 You are granted a personal, non-exclusive, non-transferable, and revocable licence to access the Content strictly for your personal, non-commercial use. You must not copy, share, re-sell, reproduce, or distribute the Content to any third party.
6.3 You agree to keep confidential all proprietary tools, insights, and personal information shared by us or other participants within group environments.
- Privacy & Personal Data
7.1 We collect, store, and process your personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy to facilitate the delivery of your Services.
- Limitation of Liability & Disclaimers
8.1 The Services and Content provided are for educational, informational, and personal development purposes only. They do not constitute professional medical, psychological, financial, or legal advice.
8.2 To the maximum extent permitted by Australian law, Kim Jones shall not be liable for any indirect, incidental, or consequential damages resulting from your participation in the Services.
- Dispute Resolution
9.1 Should any issue or dispute arise, you agree to contact us directly at [email protected] in the first instance to attempt to resolve the matter in good faith before seeking external remedies.
- Governing Law
10.1 This agreement is governed by and construed in accordance with the laws of Australia. Both parties submit to the jurisdiction of the local courts.
By purchasing the Offering, you are agreeing to abide by the terms in this contract.
